납세협력비용과 가상자산 과세제도 연구
<국문초록>
우리나라는 세 차례의 과세 유예 끝에 2027년 1월 1일부터 가상자산 양도․대여 소득에 대한 과세를 시행할 예정이다. 그러나 현행 과세제도는 세율 설계나 소득 분류의 적정성에 관한 논의에 비해, 납세자가 실질적으로 부담하는 행정적 비용인 납세협력비용에 대한 체계적 검토가 미흡한 실정이다. 이에 본 연구는 2027년 시행 예정인 가상자산 과세제도를 납세협력비용(tax compliance costs)의 관점에서 분석하고, 미국, 일본, 독일, 영국의 과세제도와 비교함으로써 제도적 개선 방안을 도출하는 것을 목적으로 한다. 이를 위해 납세협력비용 이론을 기반으로 주요국의 과세 방식, 취득가액 산정 방식, 손실 공제 및 이월 허용 여부, 과세 인프라의 네 가지 기준으로 비교 분석을 수행하였다.
분석 결과, 독일은 1년 이상 보유 자산에 대한 비과세 특례를 통해 장기보유 투자자의 취득가액 및 양도차익 계산 부담을 경감하고 있으나, 비과세 적용을 위한 보유기간의 기록 및 입증 부담은 여전히 남아 있으며, 미국과 영국은 과세 인프라 정비를 통해 납세협력비용을 점진적으로 경감하고 있다. 반면 일본은 최고 55%의 높은 세율, 손실 이월공제 불인정 등이 중첩되어 주요국 중 납세협력비용이 가장 높은 구조로 평가된다. 우리나라의 현행 가상자산 과세제도는 22%의 단일세율 분리과세 방식을 채택하고 있어 세율 수준 자체는 과도하지 않으나, 낮은 기본공제 한도, 총평균법의 실질 손익 괴리, 거래 데이터 파편화로 인한 취득가액 입증 부담, 손실 이월공제 불인정, 표준화된 보고 인프라 부재 등 복합적인 문제가 납세자의 납세협력비용을 가중시키고 있다.
이에 본 연구는 기본공제 한도 현실화 및 장기보유 우대 과세 도입, 취득가액 산정 기준의 명확화, 손실 이월공제 허용, 표준화된 과세 인프라 구축을 핵심 개선 방안으로 제시한다. 본 연구는 가상자산 과세 연구에 납세협력비용이라는 새로운 분석 시각을 도입하고, 주요 4개국의 최신 법령을 반영한 제도를 비교 분석했다는 점에서 학술적, 정책적 기여를 가진다.

<Abstract>
Korea is scheduled to implement taxation on income from virtual asset transfers and loans starting January 1, 2027, following three consecutive postponements. However, compared to the extensive discussions on the appropriateness of tax rate design and income classification, systematic examination of tax compliance costs—the administrative burden actually borne by taxpayers—remains insufficient under the current tax framework.
This study aims to analyze Korea’s virtual asset tax system, set to take effect in 2027, from the perspective of tax compliance costs, and to derive institutional reform measures through a comparative analysis with the tax systems of the United States, Germany, Japan, and the United Kingdom. To this end, a comparative analysis was conducted based on four criteria grounded in tax compliance cost theory:taxation methods, cost basis calculation methods, loss deduction and carry-forward provisions, and tax infrastructure.
The analysis reveals that Germany has established the most taxpayer-friendly structure, effectively exempting long-term investors from tax compliance costs through a complete tax exemption for assets held for more than one year. The United States and the United Kingdom are gradually reducing tax compliance costs through improvements in tax infrastructure. In contrast, Japan is assessed as having the highest tax compliance costs among major countries, due to the combination of a maximum tax rate of 55% and the non-recognition of loss carryforward deductions. Korea’s current virtual asset tax system adopts a separate taxation approach with a flat rate of 22%, which is not excessive compared to major countries. Nevertheless, a combination of complex problems continues to impose significant tax compliance costs on taxpayers, including a low basic deduction threshold, distortions between actual gains and taxable income under the weighted average cost method, the burden of proving acquisition costs due to fragmented transaction data, the non-recognition of loss carryforward deductions, and the absence of standardized reporting infrastructure.
In response, this study proposes the following key reform measures:raising the basic deduction threshold and introducing preferential taxation for long-term holdings, clarifying the cost basis calculation standards, allowing loss carry-forward deductions, and establishing standardized tax infrastructure. This study contributes both academically and from a policy perspective by introducing tax compliance costs as a new analytic framework in virtual asset taxation research and conducting a comparative institutional analysis reflecting the latest legislation of four major countries.
