긱 경제(Gig Economy) 확산과 디지털 세무행정의 패러다임 전환에 따른 정책적 개선방안

본 연구는 긱 경제(Gig Economy) 확산에 따른 노동 시장 다변화와 조세 사각지대 문제를 조명하고, 이에 대응하는 민간 세무 플랫폼과 국세청의 원클릭 환급 서비스를 비교분석하였다. 이를 위해 문헌 연구와 관련 법령 검토 및 사례 분석을 수행하였다.

연구 결과, 민간 세무 플랫폼은 긱(Gig) 노동자의 미수령 환급금을 찾아주는 경제적 효용을 창출했으나, 고율의 수수료 부과, 무분별한 스크래핑 남용에 따른 공공 전산망 마비, 과도한 개인정보 무단 수집, 무리한 부당공제 유도로 인한 가산세 피해 등 심각한 구조적 한계를 드러냈다. 이에 국세청은 수수료가 전액 무료인 원클릭 환급 서비스를 개통하여, 빅데이터 사전 검증을 통해 가산세 위험을 원천 차단하고 개인정보를 보호하는 성과를 거두었다. 그러나 정보 취약계층의 디지털 접근성 한계와 다중 소득자에 대한 세무 지원이 어렵다는 한계점을 지닌 것으로 확인되었다. 이에 정책 개선방안으로 과세정보 스크래핑을 고위험 행위로 법제화하고, 오픈 API로의 전환, 공공데이터 이용 수수료 부과 법제화, 허위과장 광고 사전 심사제 및 플랫폼 수수료율 상한제 도입, 플랫폼의 가산세 연대 배상 책임 신설, 그리고 정보 소외계층을 포용하는 세정 인프라 확충을 제시하였다.

본 연구는 민간 세무 플랫폼 서비스의 경제적 효용과 법적제도적 리스크를 규명하고, 공공 원클릭 환급 서비스의 기대효과와 한계를 종합적으로 고찰하여 납세자 권익 보호 및 공정하고 투명한 디지털 세무행정 구축을 위한 실효성 있는 정책적 개선방안을 제시하였다는 점에서 공헌점을 갖는다.

Abstract
This study highlights the diversification of the labor market and the emerging issue of tax blind spots resulting from the expansion of the ‘Gig Economy’. To address these challenges, the research provides a comparative analysis between private tax platforms and the National Tax Service’s (NTS) “One-Click” refund service, utilizing a methodology that includes literature reviews, examinations of relevant legal frameworks, and detailed case studies.

The research results indicate that while private tax platforms have generated economic utility by helping gig workers identify unclaimed tax refunds, they have also revealed significant structural limitations. These platforms have been associated with high service fees, the misuse of indiscriminate data scraping that strains public computer networks, and the excessive unauthorized collection of personal information. Furthermore, they pose serious risks to taxpayers, such as potential tax penalties resulting from the induction of unreasonable or unjust tax deductions. In response to these concerns, the NTS launched a free “One-Click” refund service that effectively utilizes big data pre-verification to fundamentally block tax penalty risks and safeguard personal data. However, the study also identified certain limitations within this public service, specifically regarding the restricted digital accessibility for information-vulnerable groups and the technical difficulties in providing comprehensive tax support for multi-income earners.

To improve the current system, this study proposes several policy recommendations. These include legalizing data scraping as a “high-risk activity” and transitioning to Open APIs, implementing usage fees for public data access, and introducing a preliminary review system for false or exaggerated advertising. Additionally, the study suggests establishing a ceiling on platform service fees, creating joint liability for platforms regarding user tax penalties, and expanding tax administration infrastructure to better embrace the digitally marginalized.

This study contributes to the field by identifying the economic utility and legal/institutional risks of private tax platform services, while comprehensively examining the expected effects and limitations of public one-click refund servicesfurthermore, it proposes effective policy improvements to protect taxpayer rights and establish a fair and transparent digital tax administration.
